Terms and Conditions

LeadDrippr is a software product for building and running email nurture sequences, connecting lead sources, and reviewing delivery and engagement metrics.

The Services (website, application, APIs, and related offerings) are provided by Rialitycheck PTY LTD (Australian Business Number 644 425 169) (“Rialitycheck”, “we”, “us”, “our”). References to LeadDrippr in these Terms describe the product; your contract is with Rialitycheck PTY LTD.

“You” means the individual or entity using the Services. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” includes the organisation.

By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services. We may update these Terms from time to time; we will post the revised Terms on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms, except where prohibited by law.

LeadDrippr allows you to configure multi-step email sequences, connect data sources (such as spreadsheets, databases, or CRM integrations made available in the product), send email through mail providers you connect (such as Gmail, Outlook, or SMTP), and view analytics associated with your sequences. Features may vary by plan. We may modify, suspend, or discontinue parts of the Services where reasonably necessary for security, compliance, or operational reasons, with notice where practicable.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. You agree to provide accurate account information and to keep your credentials confidential. You are responsible for activity under your account. Notify us promptly if you believe your account is compromised at policy@rialitycheck.com.

You agree not to use the Services to:

• Violate applicable laws or regulations, including privacy, marketing, and anti-spam laws
• Send unsolicited bulk email, deceptive messages, or content that is unlawful, defamatory, or infringes third-party rights
• Harass, threaten, or impersonate others
• Attempt unauthorised access to the Services, other accounts, or connected systems
• Interfere with or disrupt the Services, overload infrastructure, or circumvent security or usage limits
• Use the Services to distribute malware, conduct phishing, or similar abuse

We may suspend or terminate access if we reasonably believe you have breached these Terms or pose a risk to the Services or other users.

You retain your rights in data and content you submit. You grant Rialitycheck PTY LTD a non-exclusive licence to host, process, transmit, back up, and display your content solely to provide, secure, and improve the Services as you configure them.

You represent and warrant that you have all rights, consents, and lawful bases needed to import lead or contact data, to send email to recipients, and to use merge fields and integrations as configured. You are responsible for honouring unsubscribe requests and for the accuracy and legality of messages sent through the Services.

The Services may interoperate with third-party products (for example, email providers, spreadsheets, databases, or CRMs). Your use of those services is governed by their terms and privacy policies. We are not responsible for third-party availability, behaviour, or data practices.

Some features may be offered under free or paid plans. Fees, billing cycles, and taxes (if any) are presented in the product or at checkout. Unless stated otherwise, paid subscriptions renew until cancelled in accordance with the billing interface. We may change pricing with reasonable advance notice.

The Services, including software, branding, documentation, and our templates (excluding your content), are owned by Rialitycheck PTY LTD or its licensors. Except for the limited right to use the Services under these Terms, no rights are granted to you.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) or other applicable Australian consumer protection law that cannot lawfully be excluded, restricted, or modified.

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, other than non-excludable guarantees implied by law. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Rialitycheck PTY LTD and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or any loss of profits, data, or goodwill, arising from your use of the Services, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our aggregate liability for all claims relating to the Services in any twelve-month period is limited to the greater of (a) the fees you paid us for the Services in that period or (b) AUD $100 if you have not paid fees.

Where liability cannot be limited under applicable law (including non-excludable consumer guarantees), our liability is limited to the extent permitted by law.

You will defend, indemnify, and hold harmless Rialitycheck PTY LTD and its affiliates, officers, and employees from claims, damages, losses, and reasonable legal costs arising from your use of the Services, your content or lead data, messages you send, or your breach of these Terms or applicable law.

Our collection and use of personal information is described in our Privacy Policy.

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, risk to the Services, non-payment where applicable, or legal requirements. Upon termination, your right to use the Services ceases; provisions that by their nature should survive (including disclaimers, limitations of liability where permitted, indemnity, and dispute resolution) survive.

Governing law. These Terms are governed by the laws of the State of Queensland, Australia, excluding conflict-of-law rules.

Informal resolution. If a dispute arises, you and Rialitycheck PTY LTD agree to try to resolve it through good-faith discussions. Either party may start this process by sending written notice describing the dispute. If the dispute is not resolved within thirty (30) days of that notice, either party may pursue remedies in accordance with the following paragraph.

Courts. Subject to non-excludable rights, legal proceedings must be brought in the courts of Queensland, Australia (or such other Australian forum as required by law). Each party submits to the non-exclusive jurisdiction of those courts. Consumers in the European Union or other regions may have additional rights under applicable law.

To the fullest extent permitted by law, you agree to bring claims against Rialitycheck PTY LTD only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

These Terms, together with our Privacy Policy and any plan-specific terms presented in the product, constitute the entire agreement regarding the Services and supersede prior understandings on the same subject. If a provision is invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; Rialitycheck PTY LTD may assign them in connection with a merger, acquisition, or sale of assets, with reasonable notice where practicable.
